Resolved:

That the Minutes of the meeting held on Wednesday 2nd April 2014 be received and confirmed as a correct record.
209 Draft Licensing Policy 2015-19
Resolved:

That Cabinet be informed that the Committee supports the proposed draft Licensing Policy 2015-2019, subject to the inclusion of amendment to paragraph 14.6 set out below:

"14.6 In determining applications for garages (i.e. forecourt shops), the Licensing Authority must decide whether or not premises are primarily used as a garage and will expect applicants to submit data which establishes primary use. Where such information is not available (because, for example, the premises has just started trading), we may consider imposing a condition requiring this information to be provided to the Licensing Authority on a regular basis for the following years to ensure the premises are not primarily a garage."

209The Committee received an oral report and presentation from the Team Leader Regulatory Services on the revisions to the Licensing Policy for Southend-on-Sea. A copy of the draft policy for 2015-2019, which included the changes from previous policy, was presented to the Committee to enable its views to be forwarded to the Cabinet as part of the consultation process. The Committee also had before it, for information purposes, a summary of the consultation responses that had been received to date.

The Committee considered and discussed the draft policy in detail, including the evidential requirements to justify a cumulative impact policy. There was currently no evidence before the Committee for it to recommend the introduction of a cumulative impact policy at this time.
