Resolved:

That the application for a premises licence in respect of 153 North Road, Westcliff-on-Sea, Essex, SS0 7AF, be granted subject to:

(i) The mandatory conditions set out in Appendix 1 to the report of the Corporate Director for Place.

(ii) The conditions consistent with the Operating Schedule set out in Appendix 2 to the report of the Corporate Director for Place, subject to the following additional conditions:

• The Licensee shall ensure that all reasonable steps are taken to ensure that youths do not loiter within the vicinity of the premises;
• The CCTV system shall include at least one camera which covers the front forecourt of the premises.

536The sub-committee received a report of the Corporate Director for Place concerning an application that had been made by Mr T Yogananthan and Mrs S Yogananthan. for the grant of a premises licence in respect of 153 North Road, Westcliff-on-Sea, Essex, SS0 7AF.

The application was presented by Mr Paul West (21st Century Licensing). Mr Thambo Yogananthan (applicant) was also in attendance.

The sub-committee noted that no objections to the application had been received from any of the Responsible Authorities. Four representations had however, been received from local residents. No resident objectors attended the hearing. A petition comprising 19 signatures was also received. However, the Committee noted that it failed to address any of the Licensing objectives and therefore carried little weight.

The concerns contained in the four letters of objection related to the proximity of the premises to a school, other shops in the vicinity selling alcohol; groups of youths and gangs hanging around, antisocial behaviour and noise late in the evening, underage drinking and the late closing time of the premises.

At the hearing, the Applicant offered two additional conditions that could be appended to the licence, if granted, which would seek to address the concerns of the objectors.

The Sub Committee considered all the evidence and submissions that had been made at the meeting and the written documentation that had been presented prior to the hearing. The Sub Committee also had regard to the National Guidelines (June 2013) and the Borough Council's Statement of Licensing Policy and considered the four licensing objectives, namely the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm, as they related to this application.

The Sub Committee were satisfied that the conditions they will impose, together with those offered at the hearing would satisfactorily address the residents concerns. The Sub Committee therefore:
