84 8 Royal Terrace, Southend-on-Sea, Essex - Application for a Premises Licence
Resolved:

That the application for a premises licence in respect of 8 Royal Terrace, Southend-on-Sea, Essex SS1 1DY as amended be granted subject to:

(i) The mandatory conditions set out in Appendix 1 to the report of the Corporate Director for Place.

(ii) The conditions consistent with the Operating Schedule set out in Appendix 2 to the report of the Corporate Director for Place, subject to the amendments below:
• Condition 2 is deleted;
• Condition 3 to be amended to read:
"The Licensee shall ensure that a closed circuit television system is installed to the satisfaction of Essex Police to cover the areas of the bar, lounge (as shown on the deposited plans) and the outside areas of the premises. (The remainder of this condition set out in appendix 2 will remain as currently worded.)
• Condition 7 to be amended to read:
Notices shall be displayed in prominent position within the premises, including the outside areas, requesting patrons to keep noise to a minimum.
• Condition 8 is deleted.
• The Conditions will be renumbered as appropriate following these amendments.

(iii) The following additional conditions:
• The licensee shall only allow persons staying overnight at the premises or their bona fide guests (such bona fide guests shall sign a log on arrival) to purchase and consume alcohol on the premises. The log shall be made available to the police/licensing authority on request.
• No alcoholic beverages shall be taken to or consumed within the front or rear external areas to the premises.
• No bottle bins shall be emptied or collected on any day before 8.30 a.m. or after 5.00 p.m. with exception of any local authority collections outside of the licensee's control.
• The rear garden shall not be used for the consumption of beverages or food after 11.00 p.m. This area may be used as a smoking area for patrons.
• There shall be no use of the front garden after 10.00 p.m. except for access or egress to the premises.

84The sub-committee received a report of the Corporate Director for Place concerning an application that had been made by Craig Ian Developments Ltd. for the grant of a premises licence in respect of 8 Royal Terrace, Southend-on-Sea, Essex SS1 1DY.

The application was presented by Mr Craig Ravenscroft (Applicant). Ms Penelope Lewiston (a Designated Premises Supervisor with Craig Ian Developments Ltd) was also in attendance.

The sub-committee noted that no objections to the application had been received from any of the Responsible Authorities. 17 representations had however, been received from local residents, including three from the local Ward Councillors. Three of the objectors, namely Mrs Rapp, Mr Warren and Mrs Gillmore, attended the hearing and spoke. Mrs Gillmore also called two witnesses, namely Mr Goldman and Ms Brain, who also spoke and gave evidence. Their concerns related to all four of the licensing objectives of public safety, the prevention of public nuisance, the protection of children from harm and the prevention of crime and disorder.

The sub-committee noted that, prior to the hearing the applicant had amended the application removing the permission for recorded music.

At the hearing, the Applicant amended his application to remove the outside areas of the premises as a licensed area for licensable activities and withdrew the application for off sales. The applicant also offered a number of additional conditions that could be appended to the licence, if granted, which would seek to address the concerns of the objectors.

The Sub Committee considered all the evidence and submissions that had been made at the meeting and the written documentation that had been presented prior to the hearing. The Sub Committee also had regard to the National Guidelines (June 2013) and the Borough Council's Statement of Licensing Policy and considered the four licensing objectives, namely the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm, as they related to this application.
