753 Minutes of the Meeting of the Standards Sub-Committee held on Wednesday, 8th March 2006

Resolved:-

1. That the minutes of this meeting be confirmed as a correct record and signed.

2. That Councillor Terry attend the next Members Training Event, which deals with the Code of Conduct, given that he was unable to attend the one on 22nd November 2006 (Minute 1225(3)(b) refers).

3. That it be noted that the Deputy Town Clerk had written to all Members on 8th May 2006 highlighting key points and clarifying the process for Members to raise highway issues (minute 1225(4) refers).
754 Appointment of Sub-Committee of 5 Members to hold a hearing pursuant to Article 9.03(n) of the Constitution
Resolved:-

(a) That Councillor G Longley, Councillor D Garne, Mrs Farrell, Reverend Burdett and Mrs Tetley be appointed, with Mrs Rowswell as reserve. Chair to be appointed in due course.

(b) That the provisional hearing date be 4.00pm on Wednesday 7th February 2007, with a reserve date of 4.00pm on Thursday 25th January 2007.

(c) That a general training session for Sub-Committee Members be held at 6.00pm on Monday 15th January 2007, with the Standards Board DVD on Hearings being shown.
755 Training Issues
The Committee considered the current Members Training Plan.

Resolved:-

That the Training Plan be noted.
756 Standards Board Conference Round Up
The Committee considered a report on the 2006 Annual Assembly of Standards Committees.

Resolved:-

That the report be noted.
757 Recent Advice to All Members on the planning applications relating to Roots Hall and Fossetts Farm, in terms of Interests and avoiding Pre-Determination
The Committee considered recent advice given to Members concerning these high-profile planning applications.

In addition the Deputy Town Clerk reported details of the recent Court of Appeal decision in National Assembly for Wales v. Condron & Others (2006). The High Court decision was overturned and the Court of Appeal confirmed there was a clear distinction between legitimate pre-disposition towards a particular outcome and an illegitimate pre-determination of the outcome. The Deputy Town Clerk said that advice he has given to Members is consistent with the Court of Appeal's decision.

That the advice and recent decision of the Court of Appeal be noted.
