746 Apologies and substitutions.
 Apologies for absence were received from Councillor Borton (sub Cllr Nevin), A Semmence, A Clarke, M Rickett and V Copeland (co-opted members).
747 Declarations of interest.
 The following interests were declared at the meeting:

(a) Councillors Woodley, D Norman MBE, Longley and Assenheim (Executive Councillors) - interest in the referred item; attended pursuant to the dispensation agreed at Council on 19th July 2012, under S.33 of the Localism Act 2011;
(b) Councillor Salter - agenda item relating to Better Care Fund - non-pecuniary - husband is consultant surgeon at Southend University NHS Foundation Trust; son-in-law is a GP in the Borough;
(c) Councillor Phillips - agenda item relating to Better Care Fund - non-pecuniary - mother is currently in a Southend care home;
(d) Councillor Nevin - agenda item relating to Better Care Fund - non-pecuniary - Southend NHS is previous employer;
(e) Councillor Crystall - agenda item relating to Better Care Fund - non-pecuniary - Council appointed Governor at Southend University NHS Foundation Trust.

749 Better Care Fund - Section 75 Agreement

Resolved:-

That the following recommendations of Cabinet be noted:-

1. That the Council enters into an agreement under S.75 of the National Health Service Act 2006 with the NHS Southend Clinical Commissioning Group to underpin the operation of the Better Care Fund in the general form set out in Appendix 2 to the submitted report.

2. That the Corporate Director for People, in consultation with the Portfolio Holder for Adult Social Care, Health and Housing, be authorised to make final amendments to the draft S.75 Agreement as necessary.

749The Scrutiny Committee considered Minute 734 of the special meeting of Cabinet held on 23rd March 2015, which had been referred direct by Cabinet, together with the report of the Corporate Director for People which recommend that the Council enters into a formal agreement under S.75 of the National Health Service Act 2006 with the NHS Southend Clinical Commissioning Group to underpin the operation of the Better Care Fund in Southend.

In response to a question regarding the infrastructure to support integrated working and in extra care services, (Appendix 2 page 37), the Corporate Director for People said that he would review the wording of this section of the report.
