Application for Provisional Grant of Public Entertainment Licence
Resolved:

1. That the application be granted subject to the following conditions: -

(i) The submission to and approval by the Group Manager - Environmental Health of a scheme of acoustic insulation and sound control measures.

(ii) The submission to and approval by the Group Manager - Environmental Health of a scheme of managerial measures, designed to minimise disturbance to surrounding occupiers, to include a requirement that the Licensee shall appoint a named representative to be available to deal with residents' concerns.

(iii) The provisional licence shall be of no effect until declared final by the Group Manager - Environmental Health following satisfactory completion of all relevant works.

(iv) The Licensee shall comply with the content of the Council document entitled `VIDEO SURVEILLANCE EQUIPMENT - SPECIAL CONDITIONS'. The precise siting of such equipment shall be subject to the approval of the Licensing Authority and shall be recorded on a plan appended to this document. Alterations to agreed equipment siting must approved in writing by the Licensing Authority in advance of any works.

(v) Paragraph 5(b) of the Council document entitled `VIDEO SURVEILLANCE EQUIPMENT - SPECIAL CONDITIONS' is amended to read:

"Positioned to provide a clear field of view of patrons as they enter and leave, with the object of achieving a full face and full height picture of patrons both as they enter and leave the premises."

(vi) The Licensee shall ensure that only the most suitable toughened glass or non-glass drinking vessels (subject to commercial availability) are used in the premises. In assessing suitability of such vessels the principal consideration will be public safety.

(vii) The Licensee shall enter into a written and binding agreement with the Licensing Authority regarding door supervision policy, searching of patrons and procedures associated with the seizure of unlawful items. The focus of such an agreement will be The Public Entertainments Licences (Drugs Misuse) Act 1997. This agreement will be in place prior to the premises opening to the public.

(viii) The Licensee shall provide a lockable cabinet for the temporary storage of items seized in accordance with (vii) above. The construction and siting of this cabinet will be agreed by the Licensing Authority. The cabinet shall allow the secure storage of items without the need of a key to do so. Items must be accessible for removal by Police at all times the premises is in operation and the Licensee shall provide a key to be retained by the Police Licensing Unit for this purpose. All items seized will be recorded in an incident log provided by the Licensee for that purpose.

(ix) The Licensee shall provide the details of promoters and the content of promotions in the following
circumstances:-

(a) At the request of the Licensing Authority,

(b) If the Licensee(s) or their representatives become aware of information to indicate a potential risk of disorder or nuisance. When required to do so, the Licensee shall provide the foregoing information at least 14 days before the proposed promotion.

(x) The Licensee shall take all reasonable steps to ensure that no bottles or drinking vessels are taken from the premises. Patrons attempting to leave with such items will be asked to surrender them. Patrons refusing to surrender these items will be barred from the premises and shall be told this fact at the time. To facilitate this process, the Licensee shall provide conspicuous signage, visible to patrons on entry explaining this policy. The Licensee shall provide a suitable bin at the exit(s) for the safe temporary storage of glassware/bottles surrendered. The type of bin and siting to be agreed by the Licensing Authority. The foregoing shall apply whenever doorstaff are on duty at the premises.

2. That the applicant's written statement of intent as to the manner of operation of the premises together with the technical report presented to the Committee dealing with the acoustic measures relevant to such use, be noted.

84The Committee received a report of the Director of Technical & Environmental Services No. DTES 0268 concerning an application by Mr. I. Samuels for the grant of a new Provisional Public Entertainment Licence for the premises at The Piazza, Ground Floor, Maitland House, Chichester Road, Southend-on-Sea. The Applicant, Mr I. Samuels, the Co-Director, Mr D, Samuels, their legal advisor, Mr Murrell, together with his assistant and Mr R Budd of SRL Acoustic Consultants were in attendance at the meeting. Sgt. M Bell of the Police Licensing Unit was also in attendance. Mrs Shead spoke on behalf of the objectors to the application.

The Committee was informed that a further letter opposing the application had been received from the Solicitors acting on behalf of Luminar Leisure, owners and operators of Chicago Rock Cafe and Chameleon. A copy of the letter was circulated at the meeting. A plan illustrating the area where consultation on the application had been undertaken was also circulated at the meeting.

The Committee noted the applicant's written statement of intent as to the manner of operation of the premises, together with the technical report dealing with the acoustic measures relevant to such use, copies of which were presented to the Committee at the meeting. The Committee also noted the applicant's intent to liaise with the Council to consider restrictions to the western exit of the Warrior Square Car Park into Whitegate Road, to minimise diturbance to residents from traffic exiting the car park.
