261 Bellini's, 1008 London Road, Leigh-on-Sea, Essex - Application for the Variation of a Public Entertainment Licence
Resolved:

That the application for the variation of the existing Public Entertainment Licence for the increase to the terminal hour on Sundays to 12.00 midnight be approved, subject to the following conditions to address residents' concerns being attached to the Licence:

(i) The Licensee shall take all reasonable steps to ensure that no bottles or drinking vessels are taken off the site (including the outside drinking area) by patrons leaving. Patrons attempting to leave with such items will be asked to surrender them. Patrons refusing to surrender them will be barred from the premises in the future and shall be told of this fact at the time. To facilitate this process, the licensee shall provide conspicuous signage, clearly visible to patrons on entry explaining this policy. The licensee shall provide a suitable bin at the exit(s) for the safe temporary storage of glassware/bottles surrendered. The type of bin and siting shall be agreed by the Licensing Authority.

(ii) Before the formal variation of licence is issued, the licensee shall put in place appropriate managerial measures designed to prevent sound emission and reduce so far as is reasonably practicable disturbance to residential occupiers, in accordance with a scheme to be submitted to and approved by the Council's Group Manager - Environmental Health. (In the absence of such approval, the matter to be referred back to the Licensing Committee for decision.)

261The Committee received a report of the Director of Technical and Environmental Services concerning an application by the owners Bellini's for the variation to the existing Public Entertainment Licence for the premises to further extend the terminal operating hour on Sundays to 12.00 a.m. mid-night. Mr Snoxall, the manager of the premises and Mr Hook, his legal representative, were in attendance at the meeting. Councillor P Dolby of Leigh Town Council and Mr and Mrs Delaney spoke as objectors to the application.

A copy of a plan illustrating the area of consultation and the location of the responses received in respect of the application, together with a letter received from Leigh Town Council were circulated at the meeting.

The Committee was informed that, following further discussion with the Council's Legal Department and after consultation with the applicant's legal advisor, the wording of the recommendations set out in the Director's report had been amended. A copy of the letter detailing the revised wording was also circulated at the meeting.

It was noted that the application related solely to a variation for the increase of the terminal hour to 12.00 midnight and that approval to the extension to 12.30 a.m. the following morning on Sundays immediately preceding Bank Holidays (except Easter Sunday) as detailed in paragraph 4.1 of the Director's report was not being sought.
