266 The Oakwood Public House, 564 Rayleigh Road, Leigh-on-Sea, Essex - Application for the Variation of the Public Entertainment Licence
Resolved:

That the application for the variation of the existing Occasional Public Entertainment Licence to increase the number of events from 7 to 52 in any licensing year and to increase the maximum customer capacity from 150 to 200 persons be approved, subject to the following conditions:

1. The submission to and approval by the Group Manager - Environmental Health of a scheme of measures to deal with noise break out from the ventilation system and fire doors.

2. Before the formal variation of licence is issued, the licensee shall document the managerial measures designed to reduce so far as is reasonably practicable disturbance to residential occupiers, in accordance with a scheme to be submitted to and approved by the Group Manager - Environmental Health.

3. The variation to the licence shall be of no effect until declared final by the Group Manager - Environmental Health following the satisfactory completion of works reasonably required in connection with health and safety issues.

4. The use of the licence shall be reviewed after a trial period of 3 months from the date the variation takes effect and the matter considered again.

5. The licensee shall display a notice supplying the name and telephone number of a responsible person at the premises to whom residents may report concerns regarding noise and disturbance, the size and location of such notice to be approved by the Group Manager Environmental Health.

266The Committee received a report of the Director of Technical & Environmental Services concerning an application by the owners of 'The Oakwood' for the variation of the existing Occasional Public Entertainment Licence, so as to allow more frequent events and a larger customer capacity. Mr and Mrs Tarling, the Licencees, together with Mr MacFarlane, Area Manager and Mr Somarakis, their legal representative, were in attendance at the meeting. Mr Parry spoke as an objector to the application. Copies of letters that had been received subsequent to the consultation period were circulated at the meeting. A visit to view the site to which the application referred was undertaken prior to the meeting.

The Committee was informed that, whilst an increase in the customer capacity to 300 persons had originally been requested, the maximum occupancy figure now being sought had reduced to 200 persons.
267The Committee considered a schedule of provisional dates for future meetings for the remainder of the Municipal Year, a copy of which was circulated at the meeting. The Committee was informed that the meetings from January 2004 would however, be liable to change in view of the increased demand for Licensing decisions under the new legislation. Additionally, prior to January 2004, a newly constituted Licensing Committee of between 10 and 15 Members would need to be constituted under the new Licensing Act, possibly in combination with one or more Sub-Committees.
