Resolved:

That the Minutes of the meeting held on Thursday, 14 May 2009 be received, confirmed as a correct record and signed.
432 Gambling Act 2005 - Southend-on-Sea Borough Council Gambling Policy Consultation
Resolved:

That the report be noted and the draft Policy be supported for adoption by the Council.

Reasons for Decision

The current Gambling Licensing Policy must be revised every three years and therefore a review of this policy, that has been effectively consulted upon and reflects current government guidance, is essential.

The final Gambling Licensing Policy must be published by the 14th January 2010 following agreement by Council in December 2009. The final policy will also be considered at Cabinet on the 3rd November 2009.

Other Options

There is a statutory requirement for a policy to be in place that has been consulted upon and approved by the Council.

432The Committee received an oral report by the Team Leader (Licensing) concerning the Council's draft Statement of Licensing Policy in respect of its functions under the Gambling Act 2005. A copy of the draft Policy that had been approved for consultation, and a copy of the covering report of the Corporate Director Enterprise, Tourism and the Environment No. DETE 09/081 to Cabinet on 9 July 2009 had been circulated to Members of the Committee prior to the meeting. A summary of the consultation responses to the draft policy received to date, together with the number of gambling licensed premises across the Borough were circulated at the meeting.

The Committee welcomed the draft Policy and thanked the staff involved in its preparation, in particular Ms E Buchan, the Council's Assistant Solicitor.
