81 112 Bournemouth Park Road, Southend-on-Sea. SS2 5LS - Application for the Grant of Premises Licence

Resolved:

That the application for a premises licence in respect of 112 Bournemouth Park Road, Southend-on-Sea, Essex SS2 5LS be granted subject to:

(i) The mandatory conditions set out in Appendix 1 to the report of the Corporate Director for Place.

(ii) The conditions consistent with the Operating Schedule set out in Appendix 2 to the report of the Corporate Director for Place.

(iii) The following additional conditions:
• A Personal Licence Holder shall be on the premises at all times the store is open.
• The Licensee shall take all reasonable practicable steps to ensure that patrons do not loiter in the immediate vicinity of the premises.
• A suitably worded sign of sufficient size and clarity shall be displayed in a prominent position within the premises asking patrons to disperse quietly and not to loiter outside the premises.
• Two additional CCTV cameras shall be erected to cover the external areas of the premises to the satisfaction of Essex Police.
• The Licensee shall ensure that all high value drinks, namely spirits (and similar), are kept behind the counter.
• The Licensee shall ensure that a refuse bin is provided outside the premises for the disposal of litter and emptied daily.
• The forecourt shall be swept every day and litter shall be collected and disposed of daily.
• No deliveries to the premises shall be permitted before 10.00 a.m. and after 2.00 p.m. (with the exception of newspapers and magazines).

(iv) The opening hours of the premises and the permitted hours for the supply of alcohol shall be as follows:

Mondays to Saturdays - 08.00 hrs to 23.00hrs
Sundays - 08.00 hrs to 22.30 hrs
Christmas Eve and New Years Eve - 08.00hrs to 00.00 (midnight).
9.30 a.m./13.05 p.m.

81The sub-committee received a report of the Corporate Director for Place concerning an application that had been made by Mr J Kruce for the grant of a premises licence in respect of 112 Bournemouth Park Road, Southend-on-Sea, Essex SS2 5LS.

The application was presented by Mr P West (Licensing Consultant). The Applicant, Mr Kruce, was also present.

The sub-committee noted that no objections to the application had been received from any of the Responsible Authorities. 59 representations had however, been received. Three of the objectors, namely Mr Hanrahan, Mr Caplan and Mr Wilson, attended the hearing and spoke. Mr Hanrahan also spoke on behalf of Ms Best and S Benford who were not able to attend in person. The concerns related to all four of the licensing objectives of public safety, the prevention of public nuisance, the protection of children from harm and the prevention of crime and disorder.

In response to the concerns expressed at the hearing, the Applicant amended his application so as to reduce the opening hours of the premises as follows:

Mondays to Saturdays - 08.00 hrs to 23.00hrs
Sundays - 08.00 hrs to 22.30 hrs
Christmas Eve and New Years Eve - 08.00hrs to 00.00 (midnight)
(For clarification the terminal hours on Christmas Eve and New Years Eve were not amended.)

The applicant also offered a number of additional conditions that could be appended to the licence, if granted, which would seek to address the concerns of the objectors.

The Sub Committee considered all the evidence and submissions that had been made at the meeting and the written documentation that had been presented prior to the hearing. The Sub Committee also had regard to the National Guidelines (June 2013) and the Borough Council's Statement of Licensing Policy and considered the four licensing objectives, namely the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm, as they related to this application.
