305 Eastwood Food & Wine, 87 Rayleigh Road, Leigh-on-Sea, SS9 5UZ - Application for the Grant of Premises Licence
Resolved:

That the application for a premises licence, as amended, in respect of Eastwood Food & Wine be granted subject to:

1. The Mandatory Conditions set out in Appendix 1 of the report of the Corporate Director for Place;

2. The conditions drawn from the operating schedule set out in Appendix 2 of the report, subject to the amendment of Condition 3 agreed at the hearing and set out above and the amendment to Condition 7 to now read as follows:
"There shall be a minimum of two staff on duty at the premises at all times that alcohol is available for sale and, between the hours 19.00 hours until the close of business at 10.30 p.m.(22.30 hours) on Fridays and Saturdays, one of those persons shall be a personal licence holder."
3. The terminal hour for the sale of alcohol and the time the premises are open to the public shall be 10.30 p.m. (22.30 hours) daily

305The Sub Committee received a report of the Corporate Director for Place concerning an application made by Mr Pakeerathan Sivasubramaniam for the grant of a premises licence in respect of Eastwood Food & Wine, 87 Rayleigh Road, Eastwood, Leigh-on-Sea, SS9 5UZ.

The Application was presented by Mr G Hopkins (Licensing Consultant). The Applicant, Mr P Sivasubramaniam, together with Mr Thanase Garan (applicant's associate) and Ms L Potter (Licensing Consultant) were also in attendance.

The Sub Committee noted that no objections to the Application had been received from any of the Responsible Authorities but that letters of objection were received from five interested parties. Two of those objectors, namely Mrs H Lovett and Mr M Rogers, attended the hearing and gave evidence. Their concerns related to the proximity of the premises to a school; other shops in the vicinity selling alcohol and the need for another one; antisocial behaviour and noise late in the evening; underage drinking; the late closing time of the premises; and parking problems in the area.

At the hearing, the applicant accepted the conditions set out in Appendices 1 & 2 attached to the report of the Corporate Director for Place. In response to the concerns raised at the hearing, the Applicant offered to amend the application by reducing the terminal hour for the sale of alcohol and the time the premises are open to the public to 10.30 p.m. daily and to amend condition 3 of Appendix 2 to read as follows:

"No unaccompanied children under 18 years of age will be permitted on the premises after 8.00 p.m. (20.00 hours). Challenge 25 will be used to verify the age of young persons who will be asked to provide proof of age. A sign advising this shall be displayed in the front window or door of the premises"

The Sub Committee considered all the evidence and submissions that had been made at the meeting and the written documentation that had been presented prior to the hearing. The Sub Committee also had regard to the National Guidelines and the Borough Council's Statement of Licensing Policy and considered the four licensing objectives, namely the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm, as they related to this application.

The Sub Committee concluded that the concerns expressed by the residents would be addressed by the imposition of the amended conditions and the change in the terminal hour to 10.30 p.m. (22.30 hours) daily as mentioned above. It was therefore:-
