Resolved:

1. That the application be granted subject to the conditions set out in appendices 1, 2 and 3 of the report and the further conditions set out below:

• There will be no deliveries to the car park before 7.00 a.m. and after 7.00 p.m. Deliveries prior to 7.00 a.m. and after 7.00 p.m. shall be made to the front of the premises in Thorpe Esplanade.

• The applicant will use their best endeavours to ensure that coaches pick up and drop off hotel patrons at the front of the premises in Thorpe Esplanade.

• A public notice visible from the highway shall be displayed giving the telephone number of a responsible person on the premises who shall be available should a member of the public wish to discuss any matter relating to the premises.

2. At the hearing the applicant produced a plan which had been slightly amended and it is this plan that will be attached to the licence.

606The Sub Committee considered a report of the Corporate Director Enterprise, Tourism and the Environment concerning an application by Regis Entertainment Limited for the grant of a premises licence in respect of 11-12 Thorpe Esplanade, Southend-on-Sea.

The application was presented by Mr D Hook (Applicant's Solicitor). Ms J Harris (DPD and Manager of the Premises) together with Mr P Seager (Architect) were in attendance at the meeting.

The Sub Committee noted that no representations had been received from the Responsible Authorities and that measures had been agreed between the applicant and Essex Police. These were set out in Appendix 3 to the report of the Corporate Director of Enterprise, Tourism and the Environment.

The Sub Committee also noted that 13 (thirteen) letters of objection had been received from local residents, four of which letters were from 31 Colbert Avenue and were exactly the same in their wording. One of the residents, namely Mr S Rawlinson, attended the hearing and gave evidence. He also spoke on behalf of Mr and Mrs Peddie. Councillor Stafford also attended the meeting and spoke on behalf of Mrs E Holland.

The residents' concerns focussed on the licensing objective of the prevention of public nuisance and in particular noise nuisance.

The Sub Committee considered all the evidence and submissions that had been made at the meeting and the written documentation that had been presented prior to the hearing. The Sub Committee also had regard to the National Guidelines and the Borough Council's Statement of Licensing Policy and considered the four licensing objectives, namely the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm, as they related to this application.

The applicant said that having been made aware of the residents' concerns regarding noise nuisance they were prepared to offer the following additional conditions:

1. There will be no deliveries to the car park before 7.00 a.m. and after 7.00 p.m. Deliveries prior to 7.00 a.m. and after 7.00 p.m. shall be made to the front of the premises in Thorpe Esplanade.
