Resolved:

That the new Licence Conditions in respect of The Borough Hotel, 10-12 Marine Parade, Southend-on-Sea, Essex set out in Appendix 2 of the report of the Corporate Director Enterprise, Tourism and the Environment without a time limitation, be agreed.
363 Hush Bar, 19/21 Clarence Road, Southend-on-Sea, Essex, SS1 1AN - Application for the Variation of Premises Licence
Resolved:

1. That the application for the variation of the premises licence as amended be approved including the removal of conditions 5, 7, 18 and 24 and the addition of a new condition as set out below, together with the Mandatory Conditions set out in Appendix 1 of the Report of the Corporate Director Enterprise, Tourism and the Environment:

"The Licensee shall operate a "Challenge 25" scheme on the premises whereby those persons attempting to buy alcohol who appear to be under 25 years of age will be required to prove they are 18 years of age or older. Acceptable proof of age shall consist of a passport, UK photographic driving licence or proof of age cards with the "PASS" logo.

2. That the remaining conditions of the Licence shall remain in full force and effect.

362The Sub Committee received a report of the Corporate Director Enterprise, Tourism and the Environment concerning an application by Essex Police for a review of the premises licence in respect of The Borough Hotel, 10-12 Marine Parade, Southend-on-Sea, Essex.

The Application was presented by Ms J Flynn of the Police Licensing Unit. Ms A Surety of the Police Licensing Unit was also in attendance.

The Sub Committee was informed that the Licensee had introduced new management procedures, as set out in the policy documents provided in his evidence pack. Additionally the police and the Licence holder had agreed additional conditions to be attached to the licence, as set out in Appendix 2 of the report of the Corporate Director Enterprise, Tourism and the Environment.

The Sub Committee noted that the Police did not want to continue with the Application having agreed conditions with the premises licence holder and, as no representations had been made by the other responsible authorities or interested parties, it accepted the proposed resolution of the application.
363The Sub Committee received a report of the Corporate Director Enterprise, Tourism and the Environment concerning an application by Sungrasp Limited for the variation of a premises licence in respect of Hush Bar, 19/21 Clarence Road, Southend-on-Sea Essex SS1 1AN.

The Application was presented by Mr P West (Licensing Consultant). Mr T Glover, the Applicant was in attendance at the hearing.

The Sub Committee noted that seven letters of objection had been received from local residents, together with one representation from two Ward Councillors namely Councillor J Garston and Councillor M Caunce. Their objections related to all of the licensing objectives. None of the objectors attended the hearing.

The Sub Committee was informed that a reduction to the proposed terminal hour on Thursdays to Saturdays to 3.00 a.m. and to close the premises by 3.30 a.m. had been agreed between the applicant and Essex Police as set out in Appendix 2 of the report of the Corporate Director of Enterprise, Tourism and the Environment. Furthermore, there had been no other objections from the Police or other Responsible Authorities.

During the course of the hearing the Sub Committee identified that the outside area to the rear of the premise was currently being used contrary to condition 53 on the existing licence prior to this variation and requested that the applicant address this breach.

The Sub Committee considered all the evidence and submissions that had been made at the meeting and the written documentation that had been presented prior to the hearing. The Sub Committee also had regard to the National Guidelines and the Borough Council's Statement of Licensing Policy and considered the four licensing objectives, namely the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm, as they related to this application.

The Sub Committee found that the objections received had failed to demonstrate that the potential problems alleged related specifically to this premise or would lead to the licensing objectives being undermined. The Sub Committee considered that the conditions as amended would address the concerns of the residents. Accordingly, it was:-
