356 103 Hamlet Court Road, Westcliff-on-Sea, Essex, SS0 7ES - Application for the Grant of Premises Licence
Resolved:

That the application for the grant of a premises licence at 103 Hamlet Court Road, Westcliff-on-Sea be granted subject to:

(i) the Mandatory Conditions set out in Appendix 1 of the report of the Corporate Director Enterprise, Tourism and the Environment;

(ii) the Conditions drawn from the Operating Schedule set out in Appendix 2 of the report, with an amendment to Condition 3 as follows:

• No persons under the age of 18 years shall be admitted to the premises at any time.

(iii) the Conditions drawn from measures agreed between the applicant and Essex Police set out in Appendix 3 of the report;

(iv) the Conditions drawn from measures agreed between the applicant and Licensing Authority set out in Appendix 4 of the report with the following amendments for clarification:

• Condition 1:
No use (including for the purposes of loading and/or unloading of bottles/bottle bins) shall be made of the external licensed area, save for access and egress between 9.00 p.m. and 9.00 a.m., with the exception of the area marked side garden on the deposited plans which may be used as a smoking area for a maximum of 10 persons and shall be monitored and managed directly by the Premises Licence Holder. No drinks shall be taken into this area during these times. During this period, the rear garden access gate from the side garden shall be closed except for access/egress during an emergency.

Condition 3 is now deleted.

(v) The Conditions drawn from measures agreed between the applicant and Environmental Health Team set out in Appendix 5 of the report.

356The Sub Committee considered a report of the Corporate Director Enterprise, Tourism and the Environment regarding an application by Mr J Zimmerman and Mr H Mahdavian for the grant of a premises licence in respect of 103, Hamlet Court Road, Westcliff-on-Sea.

The application was presented by Mr A Murrell (Applicants' Solicitor). The Applicants, Mr J Zimmerman and Mr H Mahdavian were in attendance at the meeting.

The Sub Committee noted that no letters of objection had been received from the Responsible Authorities, although Conditions had been agreed with Essex Police, the Licensing Authority and the Council's Environmental Health Team. These were set out in Appendices 3, 4 and 5 respectively to the report of the Corporate Director of Enterprise, Tourism and the Environment. Two letters of objection had however, been received from three local residents, two of whom, namely Ms Fox and Mrs Hind attended the hearing and gave evidence. Their concerns related to all 4 of the licensing objective but primarily the prevention of public nuisance caused by noise nuisance.

At the hearing the Applicant agreed a further Condition which amended Condition 3 of Appendix 2, preventing the admission of anyone under the age of 18 years to the premises at any time.

The Sub Committee considered all the evidence and submissions that had been made at the meeting and the written documentation that had been presented prior to the hearing. The Sub Committee also had regard to the National Guidelines and the Borough Council's Statement of Licensing Policy and considered the four licensing objectives, namely the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm, as they related to this application.
