Resolved:

That the application be granted subject to:

1. The Mandatory Conditions set out in Appendix 1 of the report of the Corporate Director for Place; and

2. The Conditions drawn from the operating schedule set out in Appendix 2 of the report of the Corporate Director for Place.

994The Sub Committee received a report of the Corporate Director for Place concerning an application made by Sainsbury's Supermarkets Ltd, for the grant of a new premises licence in respect of New Garrison Road, Shoeburyness.

The application was presented by Mr Robert Botikai (solicitor for the Applicants). Mrs Joanne Surguy (Licensing Manager) was also in attendance.

The Sub Committee noted that no representations had been received from the Responsible Authorities, although letters of objection had been received from two residents, one of whom attended the meeting.

Their concerns related to all four of the licensing objectives and these included late night drinkers, anti-social behaviour, littering, vandalism, graffiti and deliveries both late at night and early morning.

The Sub Committee considered all the evidence and submissions that had been made at the meeting and the written documentation that had been presented prior to the hearing. The Sub Committee also had regard to the National Guidelines and the Borough Council's Statement of Licensing Policy and considered the four licensing objectives, namely the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm, as they related to this application.

The Sub Committee felt that, in the absence of any evidence from the responsible authorities, to support the residents' concerns, it did not believe that any of the licensing objectives would be undermined by granting the application.
