906 90 Rectory Grove, Leigh-on-Sea, SS9 2HL - Application for the Grant of Premises Licence

The Sub Committee received a report of the Corporate Director for Place concerning an application by Mr J Ganapragasam for the grant of a premises licence in respect of 90 Rectory Grove, Leigh-on-Sea, Essex, SS9 2HL

The application was presented by Mr A Aylott (solicitor for the Applicants). Mr J Ganapragasam (applicant) and Mr S Ganapragasam (applicant's son) were also in attendance.

The Sub Committee noted that a representation had been received from Essex Police as a Responsible Authority. The Police have agreed conditions with the applicant and had withdrawn their representation. A revised Operating Schedule was presented at the meeting.

The Sub Committee also noted that the applicant had amended the application to change the permitted hours for the sale/supply of alcohol from 06.00 to 23.00 to 07.30 to 23.00 Monday to Sunday.

Letters of objection had been received from 27 residents of whom 3 attended the hearing and gave evidence. Their concerns related to two of the licensing objectives, namely crime and disorder and public nuisance.

The Sub Committee considered all the evidence and submissions that had been made at the meeting and the written documentation that had been presented prior to the hearing. The Sub Committee also had regard to the National Guidelines and the Borough Council's Statement of Licensing Policy and considered the four licensing objectives, namely the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm, as they related to this application.

The Sub Committee noted that the conditions agreed between the applicant and Police as set out in the revised Operating Schedule provided at the hearing, coupled with the Mandatory Conditions set out in Appendix 1 to the report of the Corporate Director for Place and the change in the permitted hours for the supply/sale of alcohol would address the concerns of the residents and promote the licensing objectives.

The Sub Committee therefore:

Resolved:

That the application for a premises licence for 90 Rectory Grove, Leigh-on-Sea, Essex, be granted, subject to:

1. The Mandatory Conditions contained in Appendix 1 to the report of the Corporate Director for Place;

2. The Conditions consistent with the Operating Schedule provided at the hearing;

3. The amendments and new conditions set out below:

03 The premises licence holder shall ensure that there is no external disposal of refuse after 2100 and before 0800 hours daily and the external refuse bins shall be removed from the front forecourt at close of business (2300). As far as possible, the premises licence holder shall ensure deliveries are between 0800 to 2100 hours, with the exception of newspaper deliveries.

05 The premises licence holder shall ensure that reasonable and adequate staff training to a minimum of NVQ1 or equivalent is carried out and properly documented in relation to, dealing with incidents and prevention of crime and disorder; sale of alcohol (to underage, persons over 18 purchasing for underage, drunks, etc) prior to being allowed to sell alcohol.

06 The premises licence holder shall ensure that all training records are retained on the premises for 12 months and made available immediately on request to the police and local authority officers.

08 The Licensee shall install and maintain closed circuit television surveillance (CCTV) system to the reasonable satisfaction of Essex Police, including a camera covering the forecourt to the front of the shop. The system shall record in real time and images shall be retained for a minimum of 31 days and made available to Essex Police upon request. A member of staff shall always be on call during opening times that is able to download and burn off images from the CCTV system. The Licensee shall ensure that a suitably worded sign of sufficient size and clarity is displayed at the entrance to the premises and in the area of the alcohol display advising customers that CCTV is operating at the premises.

10 Notices shall be displayed in the premises to advise patrons and staff that a ‘Challenge 25', or most current drink aware scheme, operates in the premises.

Condition 14 shall be deleted as it duplicates Condition 10. As a result Conditions 15 and 16 shall be renumbered.

New Condition 14 shall read:

The premises licence holder shall ensure that any refusals of sale of age-related products are recorded in a refusals log as soon as is reasonably practicable after the sale is refused. The log should show the date and time of the event; the product(s) sought; the gender and approximate age of the customer together with a description of the customer. The log is to be perused weekly by all staff and initialled to this effect. The refusals log shall be checked and signed monthly by the designated premises supervisor. The refusals log shall be made available for inspection by the licensing authority, police or trading standards.

An additional condition which shall read:

'Outside the permitted hours for sale/supply of alcohol a lockable cover / shutters or grills shall be in place covering the areas where alcohol is sold.'
