Resolved:

That the minutes of the meeting held on 26th October 2011 be confirmed and signed as a correct record.
796 Exclusion of the Public.
Resolved:

That, under Section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting for the items of business set out below on the grounds that they involve the likely disclosure of exempt information as defined in Part 1 of Schedule 12A to the Act, and that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

797 Secondary School Transport Appeal - Pupil JF
  • (Attachment: 2)Report of Corporate Director Children & Learning
The Committee considered a report of the Corporate Director Children & Learning, together with supporting correspondence from the parent of pupil JF, in connection with an application for home to school transport assistance.

Resolved:

That the appeal be allowed and home to school transport assistance be granted until end of the school term by reason of extenuating circumstances.
798 Secondary School Transport Appeal - Pupil SA

The Committee considered a report of the Corporate Director Children & Learning, together with supporting correspondence from the parent of pupil SA, in connection with an application for home to school transport assistance.

Resolved:

That there being no circumstances reported which would justify a departure from the Council's policy the appeal be dismissed.

The Committee considered a report of the Corporate Director Children & Learning, together with supporting correspondence from the parent of pupil SW, in connection with an application for home to school transport assistance.

Resolved:

That the appeal be allowed and home to school transport assistance be granted by reason of extenuating circumstances.
800 Appeal against Termination of Contract - Employee MA
The Committee considered an appeal against dismissal submitted by employee MA. The Council's case was presented by JL supported by CS and three witnesses were called by the Council. The appellant was in attendance and presented their case.

The Committee satisfied itself that the employee had been afforded the opportunity to be represented at this meeting by a friend, trade union or their own legal representative. The employee confirmed that they were happy to proceed on this basis.

Having considered all the written evidence presented, the Committee:

Resolved:

That gross misconduct had been proven and that the appeal accordingly be dismissed.
