Resolved:

That the minutes of the meeting held on 27th September 2007 be confirmed and signed as a correct record.
820 Exclusion of the Public.
Resolved:

That, under Section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting for the items of business set out below on the grounds that they involve the likely disclosure of exempt information as defined in Part 1 of Schedule 12A to the Act, and that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

821 Appeal Against Dismissal - Employee LT
The Committee considered an appeal against dismissal submitted by employee LT. The Council's case was presented by Mr J Gray. The appellant was in attendance.

The Committee considered a preliminary issue whether all reasonable steps had been taken to ensure that the appellant had received correspondence and notification for the disciplinary hearing held on 5th October 2007 (adjourned from 14th September 2007).

The Committee noted that under normal circumstances the disciplinary hearing would be reconvened but the appellant had subsequently resigned from the post in their letter dated 10th October 2007, which was accepted by the Corporate Director Children & Learning and was no longer employed by the Council.

Having considered all the evidence the Committee:

Resolved:

1. That there was insufficient evidence to prove that the appellant had received notification of the original disciplinary hearing and therefore the original disciplinary hearing be determined not to be procedurally sound.

2. That the appellants subsequent resignation from the post having been accepted and employment by the Council ceased with effect from 10th November 2007 be noted.

*In accordance with Council Procedure Rule 40.2 Councillor Mrs Rayner asked that her name be recorded against the decision.
822 Post 16 Transport Appeal - Pupil HD

The Committee considered a report of the Corporate Director Children & Learning, together with supporting correspondence from the parent of pupil HD, concerning an application for post 16 transport assistance.

Resolved:

That the appeal be allowed and post 16 transport be granted on the grounds of exceptional circumstances.
