403 Apologies and substitutions.
Apologies for absence were received from Councillor Holland (substitute Cllr Salter) and from Councillor Chalk (no substitute).
404 Declarations of interest.
The following declarations of interest were made at the meeting:

(a) Councillors D Norman MBE, Woodley, Longley and Assenheim (Executive Councillors) - interest in the referred item (Housing Property Investment) - attended pursuant to the dispensation agreed at Council on 19th July 2012, under S.33 of the Localism Act 2011;
(b) Councillor Betson - interest in the referred item (Housing Property Investment) - Board member South Essex Homes - attended pursuant to the dispensation agreed by the Standards Committee on 10th October 2012, under S.33 of the Localism Act 2011 to participate in the debate but not vote;
(c) Councillor Assenheim - interest in the referred item (Housing Property Investment) - Board member South Essex Homes - attended pursuant to the dispensation agreed by the Standards Committee on 10th October 2012, under S.33 of the Localism Act 2011 to participate in the debate but not vote.

Resolved:-

That, under Section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting for the item of business set out below, on the grounds that it would involve the likely disclosure of exempt information as defined in Part 1 of Schedule 12A to the Act and that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Resolved:-

1. That the following recommendations of Cabinet be noted:-

"1. That subject to a viable business case, an appropriate bid, based upon external valuation advice, be made for the relevant properties.

2. That the Corporate Director for People, in consultation with the Portfolio Holder for Adult Social Care, Health and Housing and the Head of Finance & Resources, be authorised to determine the final bid price.

3. That a Local Housing Company be set up, to be financed by the General Fund, and that the Capital Programme be amended accordingly if the bid is successful."

2. That in accordance with Council Procedure 39 the matter be referred to Council for approval.

407The Committee considered a Joint Report of the Corporate Director for Corporate Services and Corporate Director for People regarding a housing property investment proposal. This had been referred direct to the special Scrutiny Committee meeting from the Cabinet meeting held on 11th November 2014 (Minute 390 refers).

During consideration of the item, the Portfolio Holder agreed to extend the delegation referred to in Resolution 2 below to all 5 Group Leaders or their nominee.
